Terms of Service

1. What this is
Capsakey is an app for Wix sites that gives each of your clients a private space for files. By installing it you accept these terms. If you are accepting on behalf of a company, you confirm you may bind it.
2. Your account and your clients
Access is granted through Wix. You are responsible for who you grant access to, and for the content you and your clients upload. We provide the mechanism; you decide who may see what.
3. Payment
Billing is handled entirely by Wix, on your existing Wix invoice, under Wix's own terms. We never see or store your payment details. Plans, prices and quotas are as shown in the app marketplace at the time of purchase.
4. Acceptable use
You may not use Capsakey to store or distribute unlawful content, malware, or material infringing someone else's rights; to send unsolicited email; or to attempt to reach another customer's data.
We do not scan file contents, so enforcement is complaint-driven. We may suspend an account we reasonably believe is being used unlawfully, and will tell you why.
5. Availability
We aim for high availability and make no formal service-level guarantee at this stage. Saying so plainly is more useful than a number we would not stand behind. The app runs on Cloudflare's global network; planned maintenance is announced in advance where practical.
6. Your data
You keep all rights in your files. We claim no licence beyond what is needed to store and deliver them to the people you have authorised. Our obligations as processor are in the Data Processing Agreement.
Uninstalling does not delete your data. Uninstallation is often accidental; deleting on that signal would be unrecoverable. Ask us in writing and we delete within 30 days, and confirm.
7. Quotas
Each plan includes a storage quota. Exceeding it prevents new uploads; it never deletes anything and never blocks reading or downloading what is already there.
If a subscription lapses, the account returns to the free quota. Files above it remain readable and downloadable — they simply cannot be added to until space is freed or the plan is renewed.
8. Liability
To the extent permitted by law, our aggregate liability is limited to the fees you paid in the twelve months preceding the claim. We are not liable for indirect or consequential loss.
Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
9. Changes
Material changes are announced at least 14 days ahead, by email to the address on your account. Continued use after that constitutes acceptance; if you disagree, uninstall and ask us to delete your data.
10. Governing law
France. The courts of France have jurisdiction, without prejudice to consumer rights under mandatory local law.
